Terms of Service

1. Acceptance of Terms

By accessing or using Pulse, operated by Def Launch, LLC DBA G8N•AI ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Description of Service

Pulse is a developer intelligence platform that provides automated changelog generation, public roadmaps, feedback collection, notifications, and announcements powered by your GitHub repository activity. We offer both free and paid subscription tiers with varying features and limits.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old to use Pulse.

4. Acceptable Use

You agree not to:

• Use Pulse for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the service, other accounts, or related systems
• Interfere with or disrupt the service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the platform
• Use automated tools to scrape, crawl, or extract data from Pulse beyond what the API explicitly permits
• Upload or transmit malicious code, viruses, or any material that could harm the service or its users
• Resell, sublicense, or redistribute access to Pulse without our written consent

5. Intellectual Property

Your Content: You retain all rights to the content you create, upload, or connect through Pulse, including your repository data, feedback submissions, and project configurations. By using Pulse, you grant us a limited license to process your content solely for the purpose of providing the service.

Our Platform: Pulse, including its design, code, features, branding, and documentation, is owned by Def Launch, LLC DBA G8N•AI. All rights not expressly granted are reserved.

6. Payment and Billing

Paid plans are billed monthly or annually as selected at the time of subscription. All fees are non-refundable except as required by law. We may change pricing with 30 days' notice. You are responsible for providing accurate billing information and maintaining a valid payment method.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by factors beyond our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by law, Def Launch, LLC DBA G8N•AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use Pulse.

Our total aggregate liability for any claims arising from or related to the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

Pulse is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

You may cancel your account at any time through your account settings. We may suspend or terminate your access if you violate these Terms, with or without notice. Upon termination, your right to use the service ceases immediately. We will make your data available for export for 30 days following termination.

11. Indemnification

You agree to indemnify and hold harmless Def Launch, LLC DBA G8N•AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of Pulse or violation of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware, and you consent to the jurisdiction of such courts.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the platform at least 30 days before taking effect. Continued use after changes become effective constitutes acceptance of the revised Terms.
